PUBLIC NOTICE
AIRCRAFT MANUFACTURING PROJECTS IN TANZANIA
1. BACKGROUND
1.1. This Public Notice is issued pursuant to powers granted to the Director General by the Civil Aviation Act CAP 80[R.E 2006] and the various applicable Civil Aviation Regulations issued under it to ensure specifically safe and secure operations of aircraft and safeguard the interest of the public and their properties from any Civil Aviation undertakings.
1.2. This notice is issued to inform the public in general of safety measures to be observed when undertaking civil aviation operations inTanzania. The Notice is issued following the Authority’s awareness that there have been individuals/organisations who claim to have the capacity to manufacture aircraft (Helicopter) and are in the process of testing the aircraft contrary to Civil Aviation Regulations and Safety Implementing Standards.
1.3. Organisations and any person intending to manufacture aeronautical products are reminded to ensure compliance to applicable Civil Aviation Regulations and obtain prior approval from the Director General of the Tanzania Civil Aviation Authority before the commencement of such undertakings.
1.4. The objective is to ensure that in the interest of safety to people and public property, standards relating to design, materials, construction equipment, performance and maintenance of aircraft or aircraft components are acceptable by the authority and comply with both national and international regulations.
2. ACCEPTANCE OF AIRCRAFT
2.1. Regulation 5 of the Civil Aviation (Airworthiness) Regulation, 2011 specifies that:
2.1.1 Authority shall only accept application for production of aircraft or aircraft component if the Authority is satisfied that-
(a) the work to be undertaken conforms to specified design as approved by the State of Design;
(b) there is in place a suitable arrangement with the holder of a type certificate which ensures satisfactory co-ordination between production and design; and
(c) thereis acceptable arrangements for oversight by the State of Design.
3. DESIGN AND CONSTRUCTION OF AIRCRAFT
3.1The International Standard as specified in ICAO Annex 8 (Airworthiness of Aircraft) specifies that“Details of design and construction shall be such as to give reasonable assurance that all helicopter parts will function effectively and reliably in the anticipated operating conditions. They shall be based upon practices that experience has proven to be satisfactory or that are substantiated by special tests or by other appropriate investigations or both.
3.2 Currently Tanzania is not a State of Design, manufacture or production of aeronautical products to be able to effectively oversee the design, manufacturing or production organisations.However, the Authority can make arrangements through cooperation with foreign Civil Aviation Authorities [eg. European Aviation Safety Agency (EASA) and US Federal Aviation Authority (FAA) to ensure that before a product is placed in the public, all the design processes, materials and applicable tests have been conducted to assure the product can endure all the stresses it will be subjected in the air without failure. All components including its engines, propeller, rotors must meet robust tests for endurance in the air.
4. CONCLUSION
4.1 In order to safeguard the safety of the public, organisations and individuals are required to ensure compliance to the Civil Aviation Act and its applicable Regulations. Henceforth no one should engage into the design, construction or manufacture of aeronautical products without consultation with the authority for formal processes and procedures to ensure all the applicable tests of materials and manufacture have been appropriately complied with in accordance with global standards for aeronautical products.
4.2 The Authority supports and encourages such innovations but should be conducted in systematic and systemic manner for the safety of all. In line with that Authority Inspectors will visit premises where such projects have been identified for more consultation and guidance.
4.3 By virtue of this notice, we urge all individuals and organizations to suspend all undertakings relating to aircraft manufacturing projects and consult the authority for further guidance.
